Marxism (Law and Social Theory) According to Marxist theory, society’s base is formed by the relations of production. The state, law and all other social institutions form part of the superstructure built on to the base and reflect that base. In Marxist theory, the law is the tool of the ruling class. Since the state and other social institutions depend upon the relations of productions, the law will, in a capitalist society, reflect the fact that the means of productions are controlled by a small ruling class. The law both legitimizes this situation and oppresses the working classes.
Question?
Is law a tool of the ruling classes?
