After reading the article on the CSI Effect, discuss how juries in trials look at physical evidence.

I think the CSI effect is definitely an interesting one, and I feel like it makes sense that jurors would interpret evidence that way. When you watch these shows you always see the big moment when the forensics team burst through the door with a case changing piece of DNA or scientific evidence. Jurors expect that every case will have these things, but sometimes that just isn’t reasonable or possible. Especially in rape and assault cases, it’s extremely easy for evidence to become contaminated or get wiped away before it’s collected. As a medic I have cut plenty of clothes and cleaned blood off enough patients to know that preserving evidence isn’t the number one priority most of the time. I think if jurors knew first hand how difficult it is to collect and protect evidence in these cases compared to what is shown on television they may have less expectations for this type of evidence in a real court setting.

The article explained that a lot of individuals in our time are exposed to the latest technology and resources available in “affluent” departments (or where many of the middle class stay around). They believe from seeing the technological advances in how to discover evidence that may have been withdrawn from the victim or the crime scene, can similarly be applicable to all sorts of crimes in every county or state – even if there is no evidence as such expected or resources available. The evidence the jury seeks is physical, and testimonial. They would believe someone else’s word in what they saw, even if the person wasn’t as close to the scene (mostly likely far away not to get a clear description). This would be a recipe for disaster in convicting the wrong person over coincidence or in desperation. 

It makes it difficult to prove someone is guilty when certain evidence is expected but not the kind the jury is looking for that may or not have been available, Even though there might be circumstantial evidence and a pattern in the suspects comings and going’s, without a finger print, photo or testimony, etc., the jury would most likely let the person go. Also, it’s concerning when the prosecutor does not make the effort to at least provide enough corroborative evidence to even reasonably stick the charges against the defendant. If there is not enough weight, then why press them? 

However, overall it shows that the public should be advised in what evidence is and how it is as effective than DNA testing if resources are not available. Such as a rape case or attempted rape. If the woman was not shown to have been penetrated because there was no semen, maybe she washed it off in disgust or the guy missed because in the struggle, she was pushing him off. Text messages, bruises, statements, ripped clothing, and a tear at the vagina is circumstantial evidence but should be considered greatly as well.
