III. Angkong is a businessman engaged in the importation and exportation of fertilizers for various crops. From time to time, Angkong imports to the country fertilizers from Thailand and distributes these to the Farmers in Isabela. Not realizing that the fertilizers contain highly toxic products both for the plant and its consumers, Angkong’s importation of 10,000 tons of fertilizers was refused entry by the Bureau of Customs. After almost a year from the original date of importation, the fertilizers remained in the custody of the Bureau of Customs. Realizing the cost to store these fertilizers, the Commissioner ordered the destruction of these fertilizers. Angkong protested against this order. He argued that since the product involved is a fertilizer, it is the Department of Agriculture, not the Bureau of Customs, that has the power to order its destruction.
