Assisted living facilities give older adults a sense of independence, even though these adults need help with daily activities. Typically, the staff at these facilities is available around the clock to assist residents. Because of the nature of assisted living facilities, staff and/or residents might become involved with helping someone in distress. Although this help is often necessary, it can involve complex challenges, including possible legal issues.
Good Samaritan doctrine is a legal principle that prevents a rescuer who has voluntarily helped a victim in distress from being sued for “wrongdoing.” Its purpose is to encourage people to help strangers in need without fear of legal repercussions should they make a mistake in treatment.
Good Samaritan laws vary from jurisdiction to jurisdiction, and generally do not apply to medical professionals or career emergency responders while on the job. Some of these laws, however, extend protection to professional rescuers when they are acting in a volunteer capacity.

The government now encourages health care facilities to have a corporate compliance program, a plan that reduces the chances that the facility will violate laws or regulations. A corporate compliance program is an organization-wide program comprising a code of conduct and written policies, internal monitoring and auditing standards, employee training, feedback mechanisms, and other features, all designed to prevent and detect violations of governmental laws, regulations, and policies. It is a system or method ensuring that employees understand and comply with laws that apply to what they do every day.

Conduct an online search to find a legal case, journal article, or detailed news article that describes a recent criminal case involving the kind of health care facility in which you are interested in working. The case you select may involve fraud or abuse (such as defrauding the Medicare or Medicaid programs, the Stark self-referral law, anti-kickback statute, or price-fixing) or other criminal act, such as patient abuse, murder, or theft. Evaluate the laws that are involved in your case, and consider the ramifications of this criminal action on the individuals and organizations involved.

Patient Autonomy or Surrogate Decision Maker?
Patients’ rights in the United States include the right to informed consent, which means that patients must receive adequate information to make medical decisions. However, many questions can arise if a patient appears to lack the capacity to understand his or her medical condition or options.
As a health care administrator, it is your responsibility to educate medical staff about your facility’s policy on obtaining informed consent, reflecting state law, and how to determine whether a patient is competent. It is essential to balance the moral needs of protecting the rights of the patient with the legal and ethical obligations to breach this confidentiality in certain select situations, or determine circumstances requiring a surrogate decision maker.
Medical staff should have no difficulty in following a patient’s wishes specific to health treatment when the patient is a competent adult who can articulate his or her wishes to the medical team. However, what if the medical team is unable to determine competency? How would the team assess mental competency to understand benefits and risks of the medical treatment? If the patient is not competent, how should the medical staff proceed?

The term advance directive refers to several different types of legal documents that may be used by a patient, while competent, to record future wishes in the event the patient lacks decision-making capacity. The choice and meaning of specific advance directive terminology depends on state law. An advance directive or health care directive may combine the functions of a living will and durable power of attorney for health care into one document in one state, but may be equivalent to a living will in another state.
Through advance directives, individuals can communicate to family members and health care providers what treatment options they find acceptable or unacceptable should they become unable to make these decisions later on. As useful as these documents are, they are not always well understood by the public.
For this Discussion, you will interview someone who has not yet completed an advance directive regarding end-of-life planning. Health care reform efforts are moving toward frameworks that reward providers for the quality of health care delivered rather than the current model, which is focused on quantity. This requires a realignment of how health care is currently reimbursed to providers. Health Insurance Accessibility
Federal and state governments have spent millions of taxpayer dollars to create a website through which consumers can purchase health care insurance in the open market. The federal government operates healthcare.gov. Some states have opted not to utilize the federal government’s exchange and approach it on their own. This has proved to be a very costly and disastrous undertaking for some states, such as Maryland, whose situation was described in this week’s introduction.
Oregon also discovered that running its own exchange can be a risky and expensive business. “Although the state has spent an estimated $248 million to get the operation up and running, it never enrolled a single private insurance customer online” (La Ganga, 2014). Oregon claims that it was not a failure of policy; the problems were in the building of the website, making the program virtually inaccessible.
With all the money spent to create these health care exchanges, the question remains: do they really work? In your Discussion this week, you will explore this question.

Whether a health care policy was formulated at the federal (country); state (providence or regional); or local level, policies inevitably have considerable impact on local health care organizations, communities, and relevant stakeholders. In other words, a health care policy that has far-reaching relevance to the nation, state, or region ultimately impacts the grassroots interests and concerns of the community.
To complete the Assignment, select a recent (within the last 5 years) health care policy that has had substantial impact on consumers. After choosing a health care policy, select a local health care organization that is impacted by that policy. This might be a public agency, a health care facility, or any organization substantially influenced by the policy. It also might be the health care organization in which you work. As an administrator in this organization, you have been tasked with preparing an assessment of the impact of the policy on the organization’s operations and outcomes. This task requires you to take a large and complex topic (the policy) and synthesize it into digestible information that organizational stakeholders can strategically use to address issues raised by the policy.
For Part 1 of this assessment, you will create a PowerPoint presentation that explains key points related to the health care policy you selected. This presentation is designed to inform and precede the dissemination of an in-depth policy assessment regarding the impact of the policy on the organization.
For Part 2, you will write an in-depth policy assessment that synthesizes the impact of the health care policy on the organization.
Part 1: PowerPoint Presentation: Key Points of a Health Care Policy
Succinct but accurate dissemination of information is often a key responsibility of a health care administrator, and understanding current changes in health care policy is an important need for many stakeholders within an organization.
For this Assignment, assume the role of a health care administrator and create a PowerPoint presentation to provide stakeholders within the organization foundational information about the policy you selected. In particular, focus on the formulation of the policy and the diverse perspectives of those who had a role in its development. As noted previously, this presentation is designed to inform the subsequent policy assessment you will distribute.
In a 12- to 15-slide PowerPoint presentation:
Briefly describe the issue addressed by the policy as well as the background of the policy’s formulation.
Identify key stakeholders involved in the evolution of this policy. Briefly explain the overarching perspectives of these stakeholders with regard to the policy.
Define which of the stakeholders would be considered advocacy groups and which would be classified as business interests. Explain how you differentiate the two categories and why this differentiation matters.
Explain the impact of the policy on key stakeholders (not necessarily within the organization). For example, how does the policy impact consumers? A health care organization?An insurance company?Providers?
Explain the role of various government agencies and officials, including public health agencies, in the formulation and implementation of the policy.
Explain the ongoing role of law and regulation in the formulation and implementation of the policy.
Part 2: Policy Assessment
Once organizational stakeholders have been given foundational and critical information about the health care policy, you will provide them with a succinct, in-depth assessment of the impact of the policy on the organization.
In a 2- to 3-page executive summary:
Briefly discuss the relevance of the policy to the organization.
Explain areas within the organization that will be affected by the policy.
Identify key organizational stakeholders impacted by this policy. Explain how they will be affected.
Assess any community impact that will need to be taken into consideration.
Describe the expected impact of the policy on organizational outcomes.

Part 4: Letter to a Policymaker
The last component, Part 4, of your Final Project is to write a letter to the policymaker that focuses on your support or opposition to thehealth care policy issue you selected for your project. Your letter should be written in a respectful, formal tone and focus on the evidence supporting your position, rather than merely expressing your personal thoughts and opinions. You should provide evidence from the peer-reviewed literature to support your position and utilize information from Components 2 and 3. Refer back to your work in Parts 1, 2 and 3 to make a compelling argument in your letter. The purpose of this formal letter is to convince the policymaker you have selected back in Part 1, of the need or urgency of support for the policy (or defeat of a current policy). Make your case! Be sure to include your chosen elected official’s actual address and use the correct salutation that is used for your elected official’s position. Label your letter as Part 4: Appendix A and add it as the fourth and final part of your cumulative course project assignment.
You should provide evidence, in the formal letter to your policy maker, from the peer-reviewed literature to support your position and utilize information from Parts 1, 2 and 3 as a unified whole to make your case for support of your position.

You will submit your Part 4 Final Project as Part 4: Appendix A and add it to your cumulative assignment document. Your instructor will grade only Part 4 for this week but all four parts must be submitted as one unified file in APA format.
Note: If you received an email confirmation from the policymaker, indicating that your letter was accepted, you may submit that as well.
