Property Manager/Tenant Conflict
Deposit: $3000
Rent: $2500 mo for a one bedroom apartment
Tenant
You were recently hired by Ginsburg company which allowed you to purchase your first house out of state. You are excited about the changes but had to break your one year lease 2 months early. Your Property Manager let you out of the lease on the condition that you actively try to fill the empty apartment with a new tenant. While you tried to find a suitable tenant to take over, you were not able to find an interested person. You were irritated by the extra work when you were madly trying to make moving preparations but made a good faith effort. You left your place in excellent condition and the walk through went smoothly on the last day. You did not receive your deposit back and you are relying on it to cover your first mortgage payment.
Property Manager
You are an experienced Property Manager of a 30 unit apartment building near Casani University. You have 10 years experience and a good working relationship with the owner (Bless Zion). You reluctantly allowed the tenant to break the lease early under the expectation that the tenant would fill the remaining two months of the one year lease. The tenant failed to find a replacement and you held onto the deposit to cover part of the $5000 loss. As it is a college town, your company only rents a unit in August or January at the start of a new semester as interest is seasonal. As a kind gesture you did not ask for the remaining $2000 at the walk through, as you knew the past tenant had moving costs.
Both Parties are negotiating for the $3000 deposit.
Act as a conflict detective. Thinking work: First, consider the emotions behind what is being said in the scenario above.
Identify the needs of the Tenant.

What obstacles are in the way of moving forward with an agreement?
If you were the tenant what approach to conflict would you most likely use (Competing, Accommodating etc)? Why?

Conflict approach to use/why: With money on the line, and two people who have different ideas of the sum owed, a collaborative approach seems impossible. The compromise approach, incurring a “partial lose-lose,” seems the best we can hope for here.
Proposed solution: The tenant and property manager need to determine the exact conditions under which breaking the lease was considered acceptable. Since the property manager agreed to break the lease early in the first place, knowing there’s a chance the spot wouldn’t be filled, they need to accept some responsibility and forfeit some of the security deposit. Since the tenant did terminate the lease early, they need to see that their security deposit was intended to prevent a financial loss to the manager/owner, and therefore accept only a fraction of the security deposit.
