The use of discretion is perhaps the most important and the most misunderstood aspect of policing. The proper use of discretion can result in leniency or a show of compassion. However, when applied unfairly, it can be viewed as discriminatory. For example, the simple act of stopping a vehicle for speeding is an activity completed thousands of times daily across our country by police officers. Many of those speeding infractions result in a citation; however, many others end with a warning. What was the reason for giving only a warning? Was it the polite behavior of the operator or the fact that the officer was in a good mood that day? Or perhaps the officer stopped an acquaintance and used discretion in deciding not to write a citation. We could argue the validity of the use of discretion in all those events. But one thing is clear: the use of discretion becomes unethical, completely improper, and illegal when discretion is used to punish or treat people differently because of their gender, color of skin, religion, and so forth.
In this module, you will build on the previous module, which focused on the police role in society and the ethical implications of police actions. In this module’s journal assignment, you will focus on the correct and poor use of discretion. Milestone Three places you in a leadership position in which you address organizational issues using leadership and ethical decision-making tools you have learned during this course. During this module, you will have an opportunity to review a 2023 podcast of an interview with the former police chief of the Ferguson Police Department.
