Discussion: Describe U.S. intelligence oversight and if you think it is a sufficient process. If not, how should it be changed? Other than issues surrounding privacy and individual freedoms (addressed next week), describe some ethical considerations concerning gathering domestic intelligence and performing intelligence activities within the homeland.

This oversight involves Congress and several other crucial players, including Executive level involvement such as the President’s Intelligence Advisory Board (PIAB), and additional support from bodies like the NSC and OMB. Congress plays a particularly important role as its oversight enables it to control resources such as funding and budgets, shape the capabilities of the Intelligence Community (IC) through legal structures, and hold influence over IC leadership electees. At the Executive level, the PIAB provides the President with assessments regarding the capabilities and actions of the Intelligence Community, which are pivotal for ensuring accountability.
Intelligence oversight is indeed a sufficient process, but its effectiveness can be enhanced when supported and complemented by other measures such as legal frameworks, internal controls within intelligence agencies, and active engagement with stakeholders and overseers. However, actions like threatening to withhold funds until compliance is met could potentially hinder the effectiveness of oversight and even jeopardize national security.
Apart from civil liberties and individual freedoms, intelligence collection efforts must adhere to non-discriminatory practices in their investigations. Highlighted in the Foreign Intelligence Surveillance (FISA) Act Amendments Act of 2008 and later cases, concerns have been raised regarding the targeting of Muslim individuals and communities. After the Protect America Act (PAA) essentially authorized the IC to target personnel from foreign countries, it was quickly amended due to unfairly singling out individuals based on religion or ethnicity.
