student 1.Unlawful questions are questions that are illegal to ask during an interview. One example of an unlawful question is asking someone “where are you from?” (Yale University N.D.). Another example of an unlawful question is asking some one “what race are you” (Beebe & Mottet, 2013). As an interviewer it’s important to be mindful of these types of questions.
These types of questions are considered unlawful because they may come off as bias. Not only that but everyone knows it’s illegal to discriminate during the hiring process for race, age, gender, etc. If someone didn’t get the job and felt it was in wrong doing they can use unlawful questions asked in the interview against the company.
If asked an unlawful question I think it’s important to determine why you may have been asked the question. Sometimes you may be in good conversation with the interviewer and they ask you personal questions based off of the topic of conversation. In this case, I would say it’s ok to answer as long as you’re ok with doing so. However if this is a question that was brought up out of the blue I think asking the interview the purpose of the question would be in your best interest.
student 2. Unlawful questions are any questions that lean toward discrimination of applicant based on race, ethnicity, sex / gender identification, age, or disability. Unlawful questions not only can bring on discrimination, but could be interpreted as disrespectful and problematic.
Examples of unlawful questions can seem very simple but show some bias. For age, these examples may seem innocent but are unlawful, such as “How old are you?” or “When did you graduate from high school?”. Or specific questions geared toward personal health status such as, “Have you had any major illnesses in the last 4 years?”, or “Do you plan to have any children?” are unlawful and frowned upon.
If an applicant is confronted with an unlawful question, the Yale University Office of Career Strategy’s web article offers two simple suggestions. One option is to “Side-step it. You could discretely refuse to answer the question but address the concerns that they raise.”. And the web article provides another option, “Question the relevance. You can ask your interviewer how the question relates to the position you’re interviewing for. This may alert them to the inappropriate nature of their question.” However, if an applicant chooses to answer a perceived unlawful question, “answer all of the interviewer’s questions honestly”. (Beebe & Mottet, 2013, p.167) When answering any question applicants should remain truthful, avoid any misrepresentations, and steer clear of any manipulation.
