I believe that discrimination can take many shapes & forms in the workplace and can target race, gender, age, disability, religion, national origin, and sexual orientation. This case is about Angela Whitfield who worked as a shift leader at its PINE Bluff Restaurant and was subject to racially offensive language. The defense brought up how such conducts violates Title VII of the Civil Rights Act of 1964, which prohibits discrimination and harassment on the basis of race.
I know that Managers may encounter several challenges when it comes to discrimination in the workplace, but they have to not only be aware but also be able to stop it and rectify the problem when it is brought to them.
Some examples of what managers can do in my opinion are the following:
Creating inclusive policies and practices: Managers need to establish and enforce policies that promote diversity and inclusion within the organization. This includes fair hiring practices, equal opportunities for training and advancement, and providing reasonable accommodations for employees with disabilities.
Responding to complaints and maintaining confidentiality: When employees report incidents of discrimination, managers must handle these complaints seriously and follow appropriate procedures for investigation. They should maintain confidentiality to protect the privacy of those involved while taking necessary action to address the issue.
Providing training and education: Managers should provide regular training to employees on topics such as diversity, inclusion, and preventing discrimination. This helps raise awareness, fosters a respectful work environment, and ensures that employees understand their rights and responsibilities.

The case I chose was: “EEOC Sues Koch Foods for Sexual Harassment, National Origin and Race Discrimination”.

- What is the case about?
- This case is about an EEOC filing by male and female Hispanic employees of Koch Foods in Morton, MS. The case centered around accusations by female Hispanic employees of sexual harassment and assault by supervisors at their place of employment. The case also states that male Hispanic employees claimed intimidation and discrimination by supervisors because of their national origin.
What are the issues that reflect discriminatory practices?
Koch Foods is accused of allowing or maintaining an environment that was hostile to its Hispanic male employees because of their race or national origin. The case contends that a particular supervisor would frequently be inappropriate with female Hispanic employees, including sexual assault. These behaviors have no place in any work environment, and I believe the supervisor may have felt empowered to commit these acts because of the complainants race, and because the behavior had not been reprimanded in any way.
Has the case been resolved?
Yes. This case was settled by Koch Foods out of court and they payed $3,750,000 to the complainants.
What are the anticipated or achieved outcomes?
Hopefully, Koch Foods will do a better job at protecting their most at risk employees as it pertains to mistreatment, harassment, and assault going forward. Having to work in an environment where you are being singled out unfairly, taken advantage of, or threatened in any way is a depressing way to make a living in my opinion. I believe Koch Foods settled because they new that the lawsuit could have garnered more in punitive damages had the case been left to the decision of a jury.
What are some of the current challenges concerning discrimination that managers will encounter?
In general, I believe managers may encounter greater challenges/opportunities of discrimination in today’s work environment due to the increase in individuals openness about their sexuality, sexual preferences, how they identify, and so on. There are individuals who may not understand or agree with this openness and this has the potential to culminate in EEOC lawsuits against the employer.
