691 Scenario for mandated counseling
The client was a 40-year-old female who had recently been convicted of
several criminal offenses, including drug possession. The client was on
supervised probation for her criminal offenses and, as part of her
sentencing, was ordered by the court to undergo an evaluation and treatment
for substance abuse.
The insured counselor was assigned to evaluate and treat the client. The
counselor’s plan of care included both individual and group therapy
sessions three times a week. The weekly fee for the counseling sessions was
$50 and would be collected from the client at the end of her therapy each
week. After approximately two months of treatment, the client advised the
counselor that she was unable to afford payment for the counselor’s
services.
In addition, the counselor learned that the client has been involved in
scamming elderly people out of money in order to pay for her drug habit.
Should the counselor report this information to the court even though the
counselor learned the information from a fellow counseling professional?
Should the counselor discuss this matter with the client first before
moving forward with the information?
The client asked if she could stop coming to counseling if the counselor
could work it out with the court. The client also asked if she could stop
coming to counseling and for the counselor to stop reporting her visits to
the court.
The counselor determines that she will be required to testify in court on
behalf of this client and her behavior. The counselor does not feel that
she is prepared to testify in court. She does not have information on the
ethical and legal responsibilities when testifying in court. In addition,
the counselor does not have malpractice insurance. She has talked to her
supervisor at the agency and the supervisor stated that the agency does not
have the funds to support her need for legal fees for obtaining assistance
in preparing for the court visit.
