Professionals are obliged to address these violations themselves, or help clients who choose to address them to do so.  When the desire to confront a colleague about an ethics violation conflicts with right to confidentiality, confidentiality takes precedence Informal Resolutions  The ethics codes recommend beginning with an informal resolution of the problem o Starts with a conversation between the concerned and the offending counselor o In depth, providing all pertinent information and involves both professionals  After the conversation, the concerned professional may be convinced that the offense did not occur or that rehabilitation efforts will be effective. At this point, no further action is necessary.  Ethics Codes on Informal Resolutions:  APA (Standard 1.04): When psychologists believe that there may have been an ethical violation by another psychologist, they attempt to resolve the issue by bringing it to the attention of that individual, if an informal resolution appears appropriate and the intervention does not violate any confidentiality rights that may be involved.  ACA (SectionH.2.b): When counselors have reason to believe that another counselor is violating or has violated an ethical standard, they attempt first to resolve the issue informally with the other counselor if feasible, provided that such action does not violate confidentiality rights that may be involved.  AAMFT (Principle 1.6): Marriage and family therapists comply with applicable laws regarding the reporting of alleged unethical conduct. Reporting Ethics Violations  A formal complaint is made when the professional doubts whether the public will be protected from further misconduct. o Client welfare is always the priority in reporting unethical behavior  Individuals may submit ethics complaints to:  Licensing boards  Professional associations  Employers  Procedures for handling complaints found in state regulations, ethics committee rules and procedures, or employee policy manuals  The central issue for the committees hearing such complaints is balancing the rights of the person making the complaint against the rights of the person accused.  As in all other aspects of U.S. society, a professional is assumed innocent until proven guilty Client Responsibility and Awareness  If a client has experienced unethical behavior by a former provider, the current provider:  Explains the client’s options about reporting  Helps the client deal with the emotions during the process  The client should be free to decide autonomously about pursuing a complaint. The complaint process is long and demanding and can result in some re-experiencing of the initial pain. If the client decides to proceed, he or she needs to recognize that its primary benefit will be to future clients of that therapist, although it’s possible the client will find the experience a healing one. Professional Responsibility and Awareness  No mental health professional is immune to unethical practice. Data suggests the most common violations are: o Confidentiality o Informed consent o Dual relationships  Studies also show that professionals express concern about their past misbehaviors and worry about future missteps. In this context, professionals ought to recognize their own vulnerability to ethical violations.  Also, professionals need to take personal responsibility and act to remedy them even if outside disciplinary bodies fail to catch the misconduct.  This obligation is consistent with the ethical ideals of mental health professions to promote the welfare of others and place clients’ needs ahead of one’s own  Professional responsibility for ethical violations involves: o Assessing the damage their misconduct has caused o Developing a plan for intervening to reduce or compensate for that damage o Receive rehabilitation so that they are less vulnerable to that violation in the future
