Case Study: Illegal Surrogacy
Fifteen people were arrested in Cambodia for allegedly taking part in illegal surrogacy, the Kingdom’s anti-trafficking authority says. The latest case comes after authorities in June arrested more than 30 women and a Chinese operator of a surrogacy ring providing children to Chinese clients. Those women — a number of whom have given birth and face the prospect of raising the children they were paid to carry — remain detained in a hospital on the outskirts of Phnom Penh. They were charged with human trafficking and faced up to 20 years in prison.
This assignment requires you to write an Essay based on the story you’ve just read posted above regarding illegal surrogacy. There are many potential victims in this scenario, including the women carrying the babies, the biological parents, and the babies. You work for the White House. They’ve received news of this story you read above, and are concerned about something like this happening in America, especially since surrogacy is not legal in every state and the laws vary on what is lawful with respect to surrogacy agreements in certain states. The Secretary of Health and Human Services is asking for your assistance in making a plan of action to help prevent such things from happening in the U.S., to help identify individuals who are victims or who may be vulnerable to becoming victims, and to offer services to help victims involved in illegal surrogacy rings. The Secretary values your sage advice and wants you to address the following:
1. Give him a summary of the case. Then, advise him if this is a common problem by doing an Internet search and reporting on whether or not you found other similar cases elsewhere. You don’t need to give facts of the cases, but do advise on where the other cases were and how big of a problem it appears to be. Also, is there any evidence that it is occurring in the U.S.? If so, give details regarding that information.
2. From a social services perspective, what can be done to identify and assist victims involved in such cases, and how can social service providers work to prevent further cases? (In this section, use some information you learned from the reading from Chapter 3 in the text Human Trafficking: A Systemwide Public Safety and Community Approach. )
3. From a health care perspective, what can be done to identify and assist victims involved in such cases, and how can health care providers work to prevent further cases? (In this section, use some information you learned from the reading from Chapter 4 in the text Human Trafficking: A Systemwide Public Safety and Community Approach. )
4. In the end, what is your personal opinion on how, if this happens in the U.S., the U.S. should treat women acting as surrogates and carrying the babies, and the biological parents who paid money to have someone carry their babies? Should these people be viewed as victims or part of the problem? Explain your responses.

- Victims were voluntarily involved (in the case of sex trafficking with adult victims)
- Did not know the victims were minors (in the case of sex trafficking with child victims)
- A means of survival
Characteristics of Human Traffickers:
- 75% of traffickers are citizens of the country of conviction (using 69 countries)
- 65% of traffickers are men, and 35% are women.
- U.S. traffickers are 33 years old on average, but can be any age in any country.
- Little is known about most trafficker’s occupation, but they can work in any type of field
