Consider the following scenario:
Robert owns a private garage where he does automobile repair and small engine repair. During his work on a vehicle, Robert spills some motor oil on the floor of the shop area. Robert attempts to clean the area and the effort seems to clean most of the oil off of the floor. However, the floor remains slick. Then, Robert decides to get some sand to cover the area. The sand is located in the rear of the structure. As Robert is headed to the rear of the structure, he receives a phone call from a private office phone that he believes he must take immediately. While Robert is on the phone, Susan, a customer, arrives at the garage to have her vehicle repaired. She sees a sign posted on the exterior of the structure next to the garage door openings on either side that states, “No unauthorized persons beyond this point.” Susan enters the garage area because she has an appointment. Susan slips on the slick area and sustains an injury that requires medical care and surgery. There is no other indication that the floor was slick except the apparent attempt to clean the spot as evidenced by smear and scrub marks.
Consider the elements of negligence, particularly the legal concepts of duty and causation. Analyze the liability of Robert in this scenario. Are the five general prongs of negligence met in this case? More so, analyze the duty that Robert has in this case and whether there is a breach of duty. Furthermore, analyze the causation that is present in this particular scenario. Detail these components as thoroughly as possible.
