Analyze Strict Liability in a Scenario
As a Regulatory Compliance Specialist, you are confronted with a situation at your company. You work for a firearms manufacturer and your role in the company is to ensure that the company is aware of the liability that the company shoulders in the production and sales of firearms to individual and corporate customers.
You have a situation with your employer dealing with the injury of a buyer of a firearm, in this case, a handgun. The buyer was shooting the firearm at a shooting range and experienced a misfire of a round of ammunition. The alleged malfunction caused a misfire, which led to an injury to the shooter’s facial area. As a matter of detail, the shooter was not wearing safety glasses or ear protection. The buyer (shooter) claimed that the company is liable for the incident and has claimed an unintentional tort in the matter.
In this assignment, you will only examine the strict liability of the manufacturer. Detail, in a technical report to your employer, the definition of a strict liability. Additionally, detail examples of strict liability for a variety of entities and/or individuals. Furthermore, consider some of the factors that may absolve the manufacturer from liability in this case. Consider hypotheticals as well. In other words, what strict liability would the manufacturer bear? What could potentially be used to mitigate or eliminate liability in this case?
