He wants to put in a brand-new deck to have family barbeques, as he dreamed of putting some steaks on the grill, for his boo. He agrees to the cost of $25,000, and gave it up to him, $12,500 up front, with the balance due upon completion of the work, which he needed for the May long weekend for a party he wanted to make it clap for the entire neighbourhood, wanting to show love in the club. He even hired a DJ that would have you falling in love, especially since Mr. Usher was still in love with you.
The work was never completed, and Mr. Usher has the following issues with the renovation. Mr. Usher says that he agreed to pay Mr. Paulo $25,000 to build a patio deck, install a glass sliding door and motion lights. Part-way through the work, Mr. Usher fired Mr. Paulo as the work that was completed was shoddy, the condition of the property was left in a mess, and Mr. Usher later paid $30,000 to another landscaping company, Lil Jon and the Eastside Boys Construction, to first clean up the mess left by Mr. Paulo and then complete the original job as required.
Mr. Paulo says that he was willing to complete the job, but Mr. Usher fired him from the job and kicked him off the job site because his work was not nice and slow to complete. He also says that Mr. Usher demanded all of the money back, but he already spent a lot of money on supplies, like glue, bricks, and the work to infiltrate and dig up the backyard. He also spent a lot of money jane on sub-contractors and that he is willing to settle the matter for Mr. Usher to just pay an additional $2,500, as most of the work was completed, and the partial performance was only because Mr. Usher refused to let Mr. Paulo come in and finish the job.
Mr. Usher acknowledges a confession of sorts about an argument he had with Mr. Paulo on the last day on the job, which was June 1st. I told him, “Yeah, OMG, I get where you are coming from but you remind me of my last contractor, who was late in finishing. I want it done my way or the highway! You make me want to find a new contractor!” Mr. Paulo insisted that he was the expert and would continue building the deck according to city bylaws, which took a little longer than expected, but would done by the following weekend.
Mr. Paulo also recognizes that the work completed was substandard and was late. Mr. Paulo blames Mr. Usher for not letting him breathe and work, for the delay, as well. Mr. Paulo insists that had he been allowed to continue the job, he would have caught up and would be moving mountains to complete what was missing, and that it would have been fixed by June 5th , just a couple of weeks late and it would never gonna be the same empty backyard, once he had this amazing new deck in place. There would be plenty of time to be burning the BBQ, ever blazing steaks, when the temperature reaches 30 degrees in July. “Mr. Usher was just a punkie, he kept telling me you don’t have to call me to access my yard, just get busy and finish the job by May 24 or he will deport them [me and my crew] off the job and hire another baby boy instead. He even tried to volunteer to work himself shouting to ‘gimme the light and pass the saw!'”
