Facts:
On August 11,1967 William Joseph Micke, Jr. was shot in his home by an armed man who had broken into his house named William Henry Furman. Before fleeing, Furman shot Micke in the chest and died instantly. The police found and arrested Furman and we was charged with murder and was tried in Georgia on September 20, 1968. Because of state law, Furman faced the death penalty despite Formans claim that the shooting was accidental(1999). However, Georgias death penalty statute at the time permitted executions even for unintended killings as long as he entered the home unsolicited (1999). The trail lasted only one day. Furman attempted to plea for insanity but was denied by the court. The court issued its decision on June 29.1972 and voted 5-4 to overturn Furmans conviction on the grounds that in his case the death penalty constituted cruel and unusual punishment(1999).
