The trust allows for the trustee to make discretionary payments of income to Diann, but Carl has not been making any payments, indicating to Diann that he is saving her money for her. Diann has been asking her brother for the last few months to provide her with information as to what monies are in the trust, how the money is invested and what income is generated.  Carl has refused to provide the necessary information.
