Part A Sony is a research historian. His main interests lie in studying prehistoric societies. In one of his research trips to an island, he discovered a rare piece of stone with some calligraphic impressions on it. Further analysis revealed that it dated back to over 5,000 years. To publicise his discovery, he published an article in the ‘Historian Manual’, a journal of the contemporary society. This brought him wide acclaim and won him prestigious awards. The islanders came to know about this and they have now instituted a lawsuit against the ‘Historian Manual’ claiming customary ownership of the copyright in stone. [5 marks) Part B Exploration Marine Ltd is an engineering firm, located on the coastal part of the Paradise Islands, specialising in salvage operations at sea. Exploration Marine has salvaged so many ships in the last 25 years of its operation. It uses sophisticated satellite data and unmanned robots to probe the depth of the ocean floor in salvage operations. In one of its routine training exercises, it located and salvaged a cargo ship in the Atlantic. The ship sunk 500 years ago. Future Insurance Company, based in Dubai, has filed an action in court, claiming the ownership of the sunken ship and its cargo. The claim was based on the fact that the ship had been insured with it and Future Insurance Company has long compensated the shipowners. Advise Exploration Marine on its rights. (10 marks)
