Author and private pilot Jett Obeejebos met financial advisor Harper Awezon on a business trip to meet with his publisher. Harper was a new advisor who had been assigned to help negotiate and draft his publishing contracts. After observing how she always looked out for his best interests and made him laugh, he fell in love with her.
One day, Harper came up with the idea of creating a pet transportation service for pets traveling solo to meet their owners or traveling with their owners by plane, train, or ship. The business would be called AweMyPet. Jett thought it was a terrific idea and encouraged Harper to pursue it.
The new business took shape swiftly, with earnings over $3 million in the first 4 months. The couple was ecstatic. Because he was a private pilot, Jett helped Harper save money on the initial domestic pet delivery flights.
Jett loved Harper so much that 6 months after meeting her, he asked for her hand in marriage. She said, “Yes!” Jett was very proud of Harper, and she was appreciative of Jett’s support and constant encouragement. Harper, however, had so much to do with her new business venture that she told Jett she needed to be engaged for at least a year.
He agreed. Both Jett and Harper were so happy about their engagement that they went out and celebrated by buying a Labrachon. They named her Express, as they felt it would symbolize or express their love for one another.
The couple has consulted your supervising attorney, Del Ivery, and asked if the law firm could prepare a prenuptial agreement for Harper and Jett.
Jett and Harper have provided the following information for you:
Dear Del:
We have combined our homes and have agreed that what we have together is ours, not his, not hers. We own a Labrachon named Express who is unaltered. In other words, she can still have puppies. We are thinking about breeding her in the future as she is so smart and doesn’t shed. Jett saw her and insisted we get her to celebrate an expression of our love. He and Express are inseparable. However, Express does cuddle with Harper if Jett is out of town. She’s kind of a fickle dog. Harper’s family helped contribute to the startup of AweMyPet in the amount of $500,000. Jett’s saved the company a lot of money by being its initial private pilot and has a lofty 401K with current value set at about $825,000. We want something that will protect his 401K and also the monies earned after we get married, plus any interest on investments, which we both agree should be Harper’s, since the company was her initial idea. Let us know if you need any additional information.
Best,
Harper and Jett

Your supervising attorney, Del Ivery, has met once again with clients Jett Obeejebos and Harper Awezon. Despite both being able to afford an attorney, these clients took it upon themselves to prepare their own prenuptial agreement. They now want your firm to review it. Further, Harper still does not truly want a prenuptial agreement, but she wants to know exactly what benefit one could provide. They also want to know if the prenuptial agreement would be valid if one of them moved to another state.
Del Ivery has provided you with the facts about this client again (from Unit 2) and left a note on your desk with the task you are to prepare.
Your Assignment:
Dear Paralegal:
Please prepare a 2-page memorandum (excluding the APA-formatted title page and APA-formatted reference page) that details your research regarding the following:
Using your state’s laws, please review the prenuptial agreement prepared by Jett and Harper, making sure that the provisions they have included are valid. If any provisions are not valid, please explain why.
Within your memorandum, make sure you detail what is needed for the agreement to be valid, citing all necessary state laws as well as whether the Uniform Premarital Agreement Act would apply.
Be sure to discuss the usefulness of a premarital agreement.
Do not forget to address whether the prenuptial agreement would be valid if one or both moved to a different state.
Facts about the clients to help you with your review:
We have combined our homes and have agreed that what we have together is ours, not his, not hers. We own a Labrachon named Express who is unaltered. In other words, she can still have puppies. We are thinking about breeding her in the future as she is so smart and doesn’t shed. Jett saw her and insisted we get her to celebrate an expression of our love. He and Express are inseparable. We want something that will protect his 401K and also the monies earned after we get married, plus any interest on investments, which both agree should be Harper’s, since the company was her initial idea.
New facts about the clients you should know:
Jett has revealed that a few pilot friends of his enjoy alcohol, and over Harper’s protests, he likes to have them visit. Harper is very close to her mother, Endora, and eventually wants her to live in the couple’s granny quarters on their property. Jett tolerates Endora but does not seem open to the living arrangement Harper has in mind.
Jett Obeejebos and Harper Awezon’s rough draft of the prenuptial agreement they have created:
In the interest of fairness and protecting one another’s hard-earned assets, and for a more peaceful life, Jett Obeejebos and Harper Awezon do hereby create the following prenuptial agreement:
In the event of a divorce, both parties agree to share custody of their beloved pet Labrachon named Express. Express will stay with Jett half of the time and the other half with Harper.
Both parties agree to waive any alimony rights, as we feel that each can make a living on his/her own.
Jett agrees to not bring any of his coworkers who drink to the couple’s home. In exchange, Harper agrees to not allow her mother to visit or live in the granny quarters on their property located at 2 Doors Down Lane in Anywhere, USA.
The parties both agree that whatever money each has made prior to their marriage is that party’s separate property. Any money Harper makes after she marries Jett will be solely hers. Any money Jett makes will be divided, with 75% being his and 25% towards their marriage in an effort to continue helping Harper’s new business AweMyPet be a success.

GEL-8.02: Apply Critical Thinking to use principles of sound reasoning.
Time flies when you are in love. A year after Jett and Harper began dating, the couple decided to drive to the state of Billyonaire and elope.
The two planned to have children eventually; however, for now, their Labrachon Express is just like a child to them. They take Express everywhere. In fact, Express is very well behaved and has flown on pet delivery flights with Jett without making a single woof.
Shortly after their marriage, Harper began to be lonely after several weeks apart from Jett. In his defense, he has been extremely busy delivering pets on behalf of AweMyPet. Harper began an affair with a country and western singer, Blake Shuttleworth, who was also a client of hers. Jett found out about the affair and is now considering a divorce.
Blake does not like dogs but does like cats. Jett is concerned about Express not getting enough attention and the care she deserves now that Harper has a new love interest. Harper’s mother Endora does enjoy being around Express.
Jett has come to your office for advice on what custody arrangements might look like should the couple not be able to work out their marital problems.
Del Ivery has provided you with some of the facts about this client from Unit 4 and left a note on your desk with the task you are to prepare.
Your Assignment:
Dear Paralegal:
Jett Obeejebos has come to our office with the following questions he would like to have answered:
Since Express is like the couple’s child, how would the phrase “best interest of the child” apply to custody and support arrangements of Express? After all, Express is Jett and Harper’s family member. Also, Express has a large food bill of approximately $550 a month, as the couple hired a private chef, Gigi Stephani, so that Express could eat fresh, balanced meals two times a day. Gigi’s fee for food preparation is $3,500 a month. She is worth every cent, as she will hand feed Express if the dog is being finicky on any given day. Express has been eating Gigi’s home-cooked meals since she was a puppy. Jett would like to have Gigi continue with this part of Express’s care. Are pets personal property? How do the courts view pets when divorce is involved?
Should the couple create a pet trust if one of them pre-deceases the other? Jett would like to know if pet trusts are upheld in your state as he is not sure where he may eventually move. He heard that community property states may view this differently but wants you to confirm how these states view pet trusts.
Please research any ethical concerns that may be present since both Jett and Harper came to our office as a couple when they were discussing their prenuptial agreement.
Please prepare a 2-to 3-page memorandum (excluding the APA-formatted title page and APA-formatted reference page) that details your research regarding our client Jett’s concerns about custody arrangements of his and Harper’s Labrachon, Express. Jett’s primary concern is Express’s physical and mental well-being.
The following are file notes regarding reminders before beginning your assignment:
Recall the facts you learned about the couple in your last assignment: “Jett has revealed that a few pilot friends of his enjoy alcohol, and over Harper’s protests, he likes to have them visit. Harper is very close to her mother, Endora, and eventually wants her to live in the couple’s granny quarters on their property. Jett tolerates Endora but does not seem open to the living arrangement Harper has in mind.” These may or may not have an impact on custody of Express.

PA250 Family Law
Unit 8 Assignment
Draft a Divorce Complaint
Course Outcome addressed in this assignment:
PA250-4: Draft a Petition for Divorce.
Instructions from your Supervising Attorney, Del Ivery:
Using the fact scenario below about Jett Obeejebos and Heather Awezon, draft a divorce complaint. You are to use California law. Make sure you indicate support, custody, and visitation within it and any property rights as well as any health insurance provisions. Note, the couple has agreed to waive any spousal support since both have great income. The length should be at least 2 pages. Be sure to read the fact scenario as well as assignment instructions thoroughly before beginning your assignment.
In this scenario, Jett wants to file for divorce. Therefore, Jett is the plaintiff, and Harper is the defendant. In some jurisdictions, the plaintiff is called the petitioner and the defendant may be referred to as the respondent. Remember, your textbook can be a great resource for your assignment.
Fact Scenario
The couple eloped and got married in Billyonaire, California 6 months ago from the date of your preparation of the complaint.
After a few short months and a suspected affair on Harper’s part, Jett filed for divorce from Harper in California. Jett (40 years old) and Harper (38 years old) have separated and are residing in different homes. Jett resides in the marital home at 1111 Money Tree Lane, San Medina, California 93400 with the couple’s Labrachon. Harper resides at her parent’s home, located at 5555 Richone Ave, San Medina, California 93400. Note, the couple were renting their marital home. The couple have one Labrachon, an unaltered female named Express who is 6 months old.
Jett has a successful career as a private pilot and author making $145,000 per year.
Harper’s income has exceeded $1.2M in the 6 short months of the couple’s marriage.
Jett has accepted a job offer to be a private pilot for Phil Bates, a biotechnical genius who has found the secret to longevity in Seattle, Washington. His new salary will be $175,000 per year, and he will receive benefits that include a pension plan, short- and long-term disability, and medical and dental insurance for him and his family. Seattle, Washington, is about 150 miles away from San Medina, California. His new job allows him to take Express with him wherever he goes.
Jett would like pet support for Express to cover the cost of paying Chef Gigi’s annual salary of $42,000 for her dog food preparation service. Also, as part of pet support, Jett would like half of the cost of Express’s monthly dog food bill of $550 and half of the amount for Express’s annual veterinary pet insurance of $600, along with half of the costs for any vet bills that may arise.
Jett will not need personal health insurance nor any support from Harper. He is confident Harper will not need either as well, since she earns nearly 10 times more income than he does. Also note that the couple does not have any life insurance policies.
Jett wants legal and physical custody of Express, as he feels he can give Express more attention than Harper, since she is so busy with her AweMyPet business as well as remaining as a financial advisor for some of her private clients. Further, Jett will have Express with him 24/7, as he is able to take her to work with him at his new job.
Harper fears that this distance would not benefit Express’s relationship with both her and Jett. Harper filed a motion for custody during the pendency of the divorce proceedings, but the issue was not addressed at the time — it was preserved to be discussed at the final divorce hearing.
Your supervising attorney, Del Ivery, has also left you a sticky note with the following on it:
Some of my own research has shown that the courts are now treating pets like family members versus treating them as personal property. Further, courts are awarding shared custody, visitation, and alimony payments to owners.
You seem to have an opportunity to be creative in your complaint, as the courts are open-minded in this relatively new area, with pet custody laws being at an all-time high.
Important Note:
The sample complaint in your text is to be used only as a guideline, as it is an example of a divorce complaint in New York, and you are preparing a complaint using California law.
Instructions
Using the sample in Chapter 14 as a guide, draft a complaint for divorce that details the above facts. Note that the clauses of the complaint should be consistent with the factual scenario. Please do not add any facts. You should use the facts presented to inform the terms of the judgment. The complaint should address and resolve all issues of the marriage, including custody, alimony, support, debts, property, and miscellaneous issues, such as life and health insurance, relocation, payment of attorney fees, etc. Please reread the bulleted list above to make sure you know which provisions you will be placing in your complaint.
You may also research and use as a guideline California form FL100 for filing for divorce.
Be sure to include the following portions of the decree based on California law: (1) Custody (physical and legal), visitation (parenting time), and all issues incidental and necessary; (2) property rights; (3) insurance provisions (health and life); (4) pet support; (5) spousal support; (6) which provisions of the decree survive and which terms merge; and (7) miscellaneous issues incidental and necessary to the decree. Of course, the standard caption and introductory paragraph and signature line for the judge should also be included.
After you have reviewed, proofread, and corrected your assignment, please submit the assignment to the Unit 8 Assignment Dropbox. Remember, Chapter 14 of your textbook has a sample for this assignment.
In addition to fulfilling the specifics of the assignment, a successful divorce complaint must also meet the following criteria:
Viewpoint and purpose should be clearly established and sustained.
Assignment should follow the conventions of Standard English (correct grammar, punctuation, etc.).
Writing should be well ordered, logical, and unified, as well as original and insightful.
Your work should display superior content, organization, style, and mechanics.
Provide an APA-formatted title page.
Keep all font color consistent throughout. If a blue hyperlink appears, remove it by hovering over it and right click. A vertical dropdown menu will appear. Click on Remove Hyperlink.
Avoid the use of first person (I, me or my).
Use bolded headings to differentiate topic areas if and where needed.
Provide an APA-formatted reference page.
Your reference page should be separate from the body of your submission.
Provide in-text citations if appropriate for the document being prepared. If in-text citations are appropriate and a reference is listed in your reference page, make sure make sure a corresponding in-text citation is included in your decree.
Provide hanging indents where needed.
In general (with the exception of filling in blanks of forms), double space throughout your submission, including throughout your reference page. Note: This includes between your references.
Use Times New Roman size 12 font.
PA250 Family Law
Unit 9 Assignment
Course outcome address in this assignment:
PA250-5: Draft a Modified Divorce Decree.
Instructions from your Supervising Attorney, Del Ivery:
Dear Paralegal:
As you know, we have an unusual divorce case involving Jett Obeejebos and Harper Awezon and their precious family member, a dog named “Express.” There has been a change in circumstance since the court ordered the couple’s divorce. Harper’s attorney, Mikael Ivengetti, won’t be happy about the modification of decree you are being asked to prepare.
The following is what the court originally ordered in its judgment of the couple’s divorce:
Harper has full legal and physical custody of Express with visitation only on two weekends a month for Jett.
Jett and Harper must pay individually for the food Express consumes whenever the dog is with either party.
Jett and Harper must pay individually for any of Express’s veterinary bills that result when Express is with either party.
Jett and Harper must pay individually for Express’s dog chef, Gigi Stephani, that portion of her salary whenever the dog is with either party.
Spousal support has been waived, so you don’t need to worry about this aspect.
Below are some of facts regarding a change in circumstances since the divorce judgment was made:
Harper’s boyfriend, with whom she now lives, refuses to feed Express if Harper is not at home.
Express has been eating twice as much, as her last vet visit indicated that she is pregnant and going to have puppies! Her food cost has increased.
Most of the veterinary bills have been paid by Jett as per the court order, as Express has only needed to go to the vet when she was with Jett. So far, Jett has paid over $650 in veterinary bills.
Harper is traveling more and more with her AweMyPet business and is hardly ever home to care for Express.
Assignment Instructions
Prepare a modification of divorce decree for Jett Obeejebos with the following requests in mind:
Full legal and physical custody of Express whereby Express will be able to reside in Settle, Washington, where Jett’s new job is located. He feels he can give Express more attention than Harper, since she is so busy with her AweMyPet business as well as remaining as a financial advisor for some of her private clients. Further, Jett will have Express with him 24/7, as he is able to take her to work with him at his new job.
Even though he is traveling, he has hired a live-in puppy sitter for when Express gives birth to her litter if he is flying at that time for his job.
Supervised visitation rights to Express for Harper twice a month, for which Jett will fly Express to Harper as Express is able to travel. (Recall, Jett is only going to be 150 miles away from Harper in San Medina, California.)
Jett would like pet support for Express to cover half of the cost of paying Chef Gigi’s annual salary of $42,000 for her dog food preparation service. Also, as part of pet support, Jett would like half of the cost of Express’s monthly dog food bill of $550 plus the additional cost of food while Express is pregnant and for up to 10 weeks after delivery of the puppies. Further, Jett wants half of the amount for Express’s annual veterinary pet insurance of $600, along with half of the costs for any vet bills that may arise regardless of whom the dog is with at the time they are incurred. You may be creative in how you express this last request by Jett.
Previous facts that may assist you in preparing your motion for modification.
Do not forget your APA-formatted title page and APA-formatted reference page.
Use the motion for modification to a divorce decree in Chapter 19 at page 473 as a guideline for requesting modification of a divorce decree.
The sample modification to a divorce decree in your text is to be used only as a guideline as it is an example of a modification in the State of Connecticut. You are preparing a modification of divorce decree using California law.
Additional Assignment Instructions
Be sure to include the following portions of the decree based on California law: (1) Custody (physical and legal), visitation (parenting time), and all issues incidental and necessary; (2) property rights; (3) insurance provisions if any (health and life); (4) pet support; (5) spousal support; (6) which provisions of the decree survive and which terms merge; and (7) miscellaneous issues incidental and necessary to the decree. Of course, the standard caption and introductory paragraph and signature line for the judge should also be included.
After you have reviewed, proofread, and corrected your assignment, please upload the assignment into the Unit 9 Dropbox. Remember, Chapter 19 of your textbook has a sample for this assignment.
In addition to fulfilling the specifics of the assignment, a successful modified divorce decree must also meet the following criteria:
Viewpoint and purpose should be clearly established and sustained.
Assignment should follow the conventions of Standard English (correct grammar, punctuation, etc.).
Writing should be well ordered, logical, and unified, as well as original and insightful.
