Imagine that you are a paralegal working for a law firm that represents a beauty salon and spa in Bloomington, Minnesota. The salon offers services including haircuts, manicures, pedicures, and facials. The salon also offers ear piercing and body piercing. Madge Bouffant, the owner of the salon, recently called with a question. Her daughter Buffy, who is a senior in high school, wants to work as a body art technician after graduation. Madge would like to hire her daughter at the salon, not only to assist with body piercing work, but also to add tattooing to the list of services offered at the salon.

According to Madge, the summer before her senior year, Buffy took an online course in bloodborne pathogens at the American Red Cross. She also worked at the salon for five weeks under the supervision of Claire, who is a licensed body piercing artist at the salon.  Madge wants to know if her daughter would qualify at this point for a license as a tattoo artist, and if so, what she needs to do to apply for the license.

Madge is heading out of town tomorrow, so she would like an answer today. The lawyer who spoke to Madge would like you to find out what the requirements currently are to become a tattoo artist in Minnesota, and compare the requirements to Buffy’s qualifications. Research applicable law in Minnesota, including both statutes and regulations, if any.

Draft an email that the lawyer can forward to Madge with the firm’s response. Explain the scope and limitations of your research, in plain language. Be sure to include any questions you have about the facts, and attach or link to any materials that Madge and her daughter might find helpful, such as agency guidance documents.
