Disabilities in the WorkplaceAccommodations

What are some of the job-related accommodationsfor disabilities that might be needed in a workplace? Perhaps there needs to bemore reserved, special parking; accessibility in a work area needs to beimproved; a work schedule and/or equipment might need to be modified; ormaybe HR needs to make sure an ASL (America Sign Language) interpreter isavailable. The U.S. Department of Labor explains that a job accommodation isan adjustment to a job or work environment that makes it possible for anindividual with a disability to perform their job duties.

Imagine that you are the HR Director in acompany that is being sued for discrimination related to a disability thatimpacts an employee in the workplace. Could this lawsuit have been avoided withappropriate accommodations? Are any of the accommodations being sought causingundue hardship, i.e., substantial difficulty or expense to the company? Howmight losing a lawsuit involving disabilities in the workplace harm yourcompany?

Usethe two cases below to prepare a 3 page paper.

For both cases:

• Provide a brief summary of each case (1-2 paragraphs), including the title and key facts, and why the company was sued by the EEOC.
  Note: Be sure to include the URL for the second case.
• Explain any harm/liability that came to the company as a result of the case findings or court opinion?  
• What, if any, accommodations were offered or requested in the case?
• Did the concept of undue hardship impact the case, and if so, how?
• What could have been done by HR to mitigate the circumstances that led to a formal lawsuit?
• What did you learn that will improve your awareness, effectiveness, and legal responsiveness as an HR professional in the workplace?
