Introduction
Over the years, technological advancements have changed how we conduct business, how we work, and how we operate on a personal and professional level. E-commerce is just one example of how technology has dramatically changed how people and businesses operate. As technology has evolved, so has the rule of law. New laws have been enacted and existing laws revised to accommodate the rapid changes. However, these laws can vary greatly from one country to the next and from one culture to the next. How we operate here in the United States might have little to no bearing on how we operate in other countries. How we operate is relative from one country to the next. This is especially true in human rights and labor law and in intellectual property rights.
Intellectual property is loosely defined as “creative.” Such property includes songs, designs, symbols, emblems, inventions, ideas, and even trade secrets. Consider the Nike swoosh, the Volkswagen emblem, and McDonald’s Golden Arches. Other companies and people cannot use these emblems. They are protected under U.S. law. The U.S. Constitution, U.S. Patent and Trademark Office, and the U.S. Copyright Office help to regulate intellectual property rights in the U.S.A.
Controlling intellectual property rights and violations in the United States is fairly easy to do. However, many other countries have a very different view of such rights and don’t have legal policies (and often the desire) to control violations. Lucy Siegel (2014) notes how the counterfeit market is becoming the norm for both consumers and vendors.

Assume you are the senior buyer for a high-end retail department store. Sales for this year are off, way off. You must increase sales and revenue, or face losing your job. An overseas manufacturer has presented you with knock-offs of a well-known, luxury brand of purses, luggage, and accessories. The company that owns this brand is not based in the U.S.A. In fact, the brand’s home country has little protection for trademarks and patents. Counterfeit is the norm. The knock-offs are so good, even you cannot tell the difference. However, you have heard that this particular factory is known for using child labor and pays low wages. You have an opportunity to make huge profit margins. If you do not purchase these goods, your competitor probably will. What do you do?
Prepare a paper that discusses the following points:
Briefly describe the ethical dilemma. Identify the facts as you see them.
What are the point and counterpoint?
Identify any legal issues you might face if you decide to purchase these goods.
What ethical issues help define your decision?
Do you purchase these counterfeit goods for the department store or not? State and justify your decision.
Consider your own purchasing habits. Would you buy a purse, a watch, or a pair of shoes that you know to be counterfeit?
Use a minimum of four credible sources, which may include this week’s supplemental reading and other sources, to support your findings and conclusions.
