The legislative role is to enact laws necessary to safeguard the population from harms and promote health (e.g., food and drug purity, occupational health and safety, and a healthy environment) (Gostin 2000, p.2838). At the federal level, the U.S. Department of Health and Human Services oversees all legislation involving healthcare. The department also oversees national licensures that moderate the industry to ensure the quality of services provided across the nation is consistent across the board. Their main objectives are to enhance availability of healthcare services and affordability as well as better quality of healthcare. The public healthcare service has many agencies that deal with the regulation of healthcare. State have their own ways of extending their control, however, they do no regulate issues of healthcare that may relate to large national employers due to preemption. Preemption is the displacement of U.S. State law by U.S. Federal law (Field, 2007).
