Parole Evaluation Case Data Gerald Smith is a 35 year old male inmate at the Fictional State Prison in Noname, KY. He is currently in the 15th year of a 25 year sentence for a homicide committed during an attempted robbery in 1998. As per the sentencing guidelines Mr. Smith became eligible for parole after completing 15 years of his sentence. His attorney and the parole board have requested an evaluation to assist in determining whether or not to release him on parole rather than letting him finish the 10 remaining years of his sentence. Mr. Smith was raised by his maternal grandmother (Ruby Jones) after his mother died of a drug overdose when Bubba was 2 years of age. He never knew his father and his mother, who often prostituted herself for drugs, and she did not know who his father was. Mrs. Jones was an attentive but stern caretaker, however, she was 64 years old and in poor health when Gerald came to live with her. By the time he was a teenager, she could no longer supervise him properly, and much of the time he came and went as he pleased. He frequently skipped school and although he was not a significant discipline problem, dropped out of school at 17, having failed most of his classes. He was interested in playing sports, and was a gifted athlete, however, his school performance made him academically ineligible to play any varsity sport by his sophomore year of high school. He took a series of low-paying jobs, that consistently ended in being fired for failing to show up for work. He eventually fell in with a street gang and was recruited to make drug deliveries to local dealers. In the process he began sampling the product and quickly became addicted to both Cocaine and Alcohol. Over the course of two years he was in and out of jail for drug possession, petty theft, assault (while intoxicated) and public intoxication. In the course of holding up a drug store, he shot and killed the store manager. Mr. Smith states that he was so high at the time that he doesn?t remember anything from that night. Initially, his lawyer suggested he be evaluated to determine his competency to stand trial. The assessment indicated his Full Scale IQ (FSIQ) was 108 and that he did not have any mental deficiencies, defects or disorders that would impair his ability to cooperate with his attorney. His lawyer then advised him to plead guilty and ask for leniency in sentencing since he did not have a prison record. As stated earlier, he was convicted of First Degree Murder and sentenced to 25 years, with the possibility of parole after 15 years. Since his incarceration, he has been an exemplary prisoner. He has taken advantage of the Prison College Exchange Program and has accumulated nearly 90 hours of college credit at a 3.61 GPA. He also began attending AA and NA meetings shortly after he began his sentence and has been a consistent participant in both programs. He has even ?sponsored? several inmates in the program. He has attended the protestant worship services regularly, but hesitates to say that he has ?gotten religion?. He has been assigned various duties at the prison, including the laundry, kitchen, motor pool, grounds-keeping, and library. He has done all duties assigned with a minimum of disciplinary action. Early in his sentence his prison work habits resembled his habits on the ?outside? and he was frequently late or did not show up for work, for which he received consequences of reduced ?yard time?, less desirable duties, and restriction to his cell. It has been 7 years since the last disciplinary action taken against him. As part of the evaluation process, Gerald was administered the MMPI-2. It was noted that he answered all 567 items of the test. On the Validity Scales (L. F, and K scales), he achieved T-scores of 58, 48, and 65 respectively. His F scale is in the middle of the Average range and suggest valid responses. His L (Lie) scale was in the upper half of the Average range, which indicates some untruthfulness, but not to a pathological degree. K scale scores on the MMPI-2 above 65 are indicative of defensive responding, or presenting oneself in a more favorable manner Gerald?s score (K= 65) is right at the cutoff for defensive responding. On the clinical scales he generated the following T-scores: Hysteria (T= 45), Paranoia (T= 66), Schizophrenia (T= 51), Masculinity/Femininity (T=52), Psychasthenia (T= 65), Hypomania (T= 69), Hypochondriasis (T= 43), Social Introversion (T= 68), and Psychopathic Deviate (T= 70). Additionally, the Hare Psychopathy Checklist Revised (PCL-R) was administered. The PCL-R uses a 3-point scale (0, 1, or 2) to identify the extent to which an individual exhibits the 20 characteristics (of psychopathy) on the checklist. (0 = consistently absent, 1 = inconsistent, 2 = consistently present). The PCL-R also divides the characteristics into two factors: Factor 1 is related to the callous, selfish, remorseless use of others, and Factor 2 is the chronically unstable lifestyle. Total scores range from 0-40 on the checklist. The mean score for offender populations in prison is generally between 22-24. Scores of 30 or higher is generally indicative of Psychopathy. Mr. Smith obtained a score of 14 on Factor 1 and 14 on Factor 2, giving him a Total Score of 28 on the PCL-R. ? ? Answer preview.
