Post a substantive response to the question (minimum 250 words). Provide 5 acceptable interview questions and 4 unacceptable questions. Explain why the questions are acceptable and potentially illegal. Reply in a scholarly and substantive manner to the following two classmates(Adeline)Pre-offer stage and post-offer stage in the interviewing process have different acceptable and unacceptable interview questions. In the pre-offer stage, an employer can not ask questions related to disabilities and medical examinations. Once an offer is made, it is acceptable for employers to ask questions relating to disabilities and conduct medical examinations, ONLY if they do this for everyone in the same job category. Acceptable Questions1) Are you able to perform the essential functions of the position for which you are interviewing with or without a reasonable accommodation? This question can help to ensure that an applicant believes that he/she is able to successfully perform the job, whether they were offered necessary accommodations. This question does not require details, it is more so a simple yes or no, and based on what the applicant believes. When this question is asked, interviewers should not persist with trying to learn more until in the post-offer stage, when accomodations can be discussed. 2) Why did you leave your last job? This question is acceptable and important for interviewers to ask. It is important to understand why an applicant left their former position when determining whether or not they will be a good fit for your organization and the position at stake. 3) What is your work experience? This question is also acceptable and important for interviewers to ask applicants. An individual’s work experience plays a great deal in whether or not they will be able to perform the job at hand and whether or not they will be a good fit. 4) Identify three of your greatest strengths? This is an acceptable open-ended competency-based question that can be used to allow an applicant to highlight whatever they believe to be their greatest strengths and best assets that they could offer to an organization. 5) Identify your worst weakness? This is another acceptable open-ended competency-based question. I think that I have been asked this question, or at least something similar, in every interview that I have ever had. This is a good opportunity for interviewers to learn possible weaknesses in the applicants and areas that could be worked on. Unacceptable Questions 1) Do you have, or plan on having kids in the future? This question is unacceptable, and potentially illegal, because it could be used, or implied, that organizations will base their offers on whether or not an individual has a child or ever will have one. This is also unacceptable because pre-offer interview questions need to be asked across the board, asking a female about her home life could be perceived as sexist. And just because an individual does have a family life, does not mean that their work life will be impacted. 2) Do you think you would need any accommodations to perform this job? This question is illegal to ask during the pre-offerstage because it is considered a disability-related question. The interviewer would be asking the applicant to disclose disability-related information. Once a job offer is made, this question could be asked to ensure that an individual will have everything they need in order to perform the job. 3) How old are you?Questions attempting to determine the age of applicants are unacceptable and potentially illegal. Instead, interviewers should ask if the applicant meets any age-required conditions of the job, if applicable. And if these questions are asked, they must be asked to everyone, not just individuals that the interviewers think look young or old. 4) Where were you born? This question is unacceptable and illegal because it discloses information about an individual’s background that is unnecessary when determining whether or not they are capable of doing a job. It could seem as though organizations use this question to discriminate against individuals born in certain areas or of certain races. Muller, Max. (2013) The Manager’s Guide to HR. New York: AMACOM.(Janaina)The questions bellow are acceptable because they’re within the competency-based criteria used to ask job-related issues only. Muller (2013) explains “your safest legal course is to center interview questions and comments on job-related issues and, to the greatest extent possible, ask all applicants the same core questions.” (p.23). By having a structured interview system and applying the same interview method to all applicants, employers are being unbiased avoiding falling under the characteristics of discrimination. Tell me about your most recent experience. What were your biggest achievements in your past experience? What are your expectations regarding the job? Tell me about a time you’ve positively guided and influenced a group of people. Are you willing to travel for work? The questions bellow are an example of NOT TO ASK type of questions because they sound casual and do not regard the job. They can make the applicants uncomfortable and that can result in discrimination charges. “Treating an interview in a casual manner is a surefire way to find yourself being charged with discrimination.” (Muller, 2013, p. 22). How do you manage your time between family and work? What would you do if you have to travel for work when your kids are sick? When did you move to the U.S.A? How comfortable are you with your English? Have you ever been absent from work due to mental health issues? References: Muller, M. (2013). The Manager’s Guide to HR.
