Assignment: Consider and discuss reproductive rights and freedoms of socio-economically disadvantaged (i.e., poor) women in the context of federal and state laws involving abortion. Under current federal law, as established by Roe v. Wade, 410 U.S. 113 (1973), the government may not interfere with a woman’s right to abortion in the first trimester. However, in several states, certain laws have been enacted that may tend to establish obstacles to a woman’s ability to terminate a pregnancy via abortion, including, for example, a requirement that the woman’s physician must have admitting privileges at a hospital (which thereafter may combine with rules denying admitting privileges to physicians who perform abortions).The “prompt” is two-fold: First, whether (a) federal abortion law which effectively purports to grant women (limited) reproductive liberty and ‘choice’ actually tends to oppressively operate to coerce economically dis-advantaged (i.e., ‘poor’) women to terminate pregnancies for reasons traceable to personal judgments regarding lack of financial means necessary to sustain a child from infancy to adulthood, or (b) certain state laws restricting access to abortion effectively operate to deny poor women abortion related reproductive rights and liberties vis-a-vis wealthy women, who may more easily afford to travel to another state which does not impose similar restrictions, or (c) both (a) and (b). Second, what legal solution, i.e., law(s), would you propose to most fairly equalize and honor reproductive rights and liberties of all women, i.e., to level the playing field as between the rich and poor?
