This week, we are tasked with exploring the implications of “Smart Borders” in enhancing detection capabilities and examining the profound impact of Intellectual Property (IP) theft, mainly focusing on the challenges posed by Chinese efforts to misappropriate IP.
Smart Borders and Detection Capabilities: “Smart Borders” integrate advanced technologies to improve the monitoring and management of border crossings. This concept leverages biometrics, facial recognition, and automated passport control systems, significantly enhancing border detection capabilities. These technologies allow quicker verification of identities and credentials, leading to more efficient and secure border operations. For instance, using RFID chips in passports and other travel documents provides real-time data exchange, crucial for detecting fraudulent activities and preventing unauthorized entries (Andreas, 2009).
Economic Impact of IP Theft and Border Security in 2022: Intellectual Property theft, particularly by Chinese entities as outlined in numerous reports, continues to pose a significant threat to the global economic structure. The U.S. economy, highly reliant on innovation and intellectual property, loses billions annually due to IP theft, affecting industries ranging from technology to pharmaceuticals. The ongoing theft undermines corporate competitiveness and jeopardizes national security by potentially giving foreign adversaries access to cutting-edge technologies and trade secrets (USTR, 2017).
Addressing Chinese IP Theft: A multifaceted approach is necessary to combat China’s extensive IP theft. Strengthening domestic and international legal frameworks can enhance enforcement against IP violations. This includes imposing stricter penalties on IP theft and ensuring consistent enforcement across all levels. Fostering international cooperation through diplomatic channels and trade agreements can pressure China to adhere to global IP standards and practices. Enhancing cyber defenses within corporations, especially in critical technologies and sectors, is also essential to guard against cyber espionage and theft.
As we continue our discussion, let us consider how these technologies and strategies can be balanced with the need to maintain robust trade and international relations, ensuring that border security and IP protection do not impede economic growth but support sustainable development.

Response #2 (Fuller): A smart border is utilizing a nesting of equipment, personnel, and technology intertwined together to ensure the highest level of security in order to ensure the safety of the border and detect any fraudulent or illicit activities at our borders. The implementation of smart borders is something that we have only seen at the northern portion of our border with Canada. It was a process that started in 2001 with the development of a 30-point action plan that focused on strengthening the borders (Andreas, 2009, p. 154). With the capabilities and the relationship that we have with Canada it is feasible to implement a smart border with them. Our southern western board to Mexico is a more delicate situation to attempt to implement a smart border plan into action. This is due to the relationship between Mexico and the United States and other factors such as Mexico’s capabilities to provide matched resources on their side of the border.
Intellectual property is any item that is created by an individual that could possibly hold a patent or copyright. It is important to have a good stronghold on intellectual properties and ensuring that we are protecting his safeguarding is monetary value and utilizing capabilities and resources in order to mitigate fraudulent activity in order to protect the monetary value and safety of the United States. Intellectual property rights violations pose great risk to the American public both from a safety and health standpoint, they create vulnerabilities against the integrity of critical infrastructure and America’s overall national security. The example in this week’s reading talked about software that would be used for security at our US and Mexico border and the affects it would have should this software be stolen and be able to be replicated or impacted by an outside entity. This type of example is a great example to understand the intellectual properties of the software that is created by the United States the monetary value comes from its ability and services that it provides to provide protection Arab orders by providing safety (National Intellectual Property Rights, 2011). Impacts from intellectual property rights violations would put the national security at risk and have a multitude of 2nd and 3rd order of effects. The more intellectual property rights violations that occur in the United States the go to the impact on our economy we see based off individuals seeking to buy items at a lesser amount and or buying illegal illicit products and not paying taxes which in return create a decrease in tax revenue in funding agencies that run off this income such as federal agencies that provide are Nations Security. This creates decreases in funding which impact resources and capabilities that the agencies can provide which could create vulnerabilities and gaps in our nation’s security that could be exploited upon by our adversaries.
China is a significant player in intellectual property violations and theft as they have continually sought to utilize the impacts of this type of violation to impede the economic stature of the United States and cause a ripple effect to impact the safety and stability of the United States and undermining its overall abilities and functionality on a global stage. The United States has a responded in many ways based off the presidential administration that is in the White House at they give in time. When evaluating the trump administration, we saw a very direct hands-on approach with tariffs and other aggressive efforts to block Chinas ability to operate these types of violation). Individuals that had strong ties to military civil fusions were denied visas to enter the United States. China received heavy tariffs and other consequences for their actions in hopes to force China to decrease IP thief due to punishments that resulted from those actions.
An aggressive approach must be taken in response to any individuals regardless of a country whether it be China or not who attempt to impact the United States of America through IP theft. It is imperative that violation sanctions tariffs and other forms of punishment being implemented on these individuals to show a united standard and punishment for individuals that seek to utilize these types of violations as a means to undermine and impact the security and safety of the United States of America. Changes in these types of punishments or a lack of accountability from the United States displays weakness in the United States to stand by its legislation and further feeds into the efforts of these individuals to attempt to make the U.S. appear weak on the global scale.
