Sexuality is a topic that most adolescents avoid talking about due to either embarrassment or fear. It is important as providers, to create a safe and non-judgmental environment when asking teens about their sexual health. Studies have shown that adolescents are less likely to receive confidential care due to feelings of awkwardness, lack of trust, and fear of their parents finding out. Confidentiality in adolescent health care is important because it encourages these patients to seek care and they may disclose sensitive information that will allow providers to deliver appropriate care (Pampati et al., 2019).
If a father of a 17-year-old wants to know if his child is sexually active, I would express that I cannot confirm any information regarding their child’s status due to confidentiality. If the child wants them to have access to their records, that is possible. However, whether the father gets the answers he wants or not, I would encourage him to speak on the importance of sex education to his child and how to practice safely if the child decides to make that decision. By opening a discussion with his child, he or she may feel more comfortable talking with their parents.
Regarding the 14- and 11-year-old, there are federal and state laws that affect confidentiality. There should be private conversation time for the provider to discuss things with the patient and the provider should educate both parents and adolescents on what confidentiality is. HIPAA allows a parent to have access to medical records for children underage if a minor obtains care at the direction of a court, when a parent agrees that the clinician and minor may have a confidential relationship, and when the minor has consented for the care and consent of the parent is not required by state or other laws (Pathak & Chou, 2019).
There are some exceptions to confidentiality protected by law. This includes when a provider determines that the minor is in danger of violence to themselves or a victim of sexual, emotional, or physical abuse. Also, when sexual activity occurs with an adult and a minor, that is considered illegal and can be reported. Child abuse can be described as abandonment, harm, mental injury, neglect, and sexual abuse. Health care providers often face challenges when trying to understand confidentiality as it relates to their practice. Certain laws can affect how they discuss confidentiality with their patients, and some may have their own values or views on what is deemed as confidential or when they feel obligated to speak (Pathak & Chou, 2019).
The Florida law regarding parental notification consists of reporting dangerous situations such as child abuse and sexual abuse. A provider may not prescribe medicinal drugs to a minor child without first obtaining parental consent. In the state of Florida, a minor may receive all services related to sexually transmitted diseases but only have access to some contraceptive services without an adult. However, in the case of abortion services in a minor, parents must be notified and consent before going through a procedure. Also, any medical procedure in general cannot be performed on a minor without written parental consent. Although confidentially is very important, if it is at the expense or harm of a child, parents should be notified (Online Sunshine Florida Statutes, 2023).
