Assignment #1 – Applying Expert Witness Evidence Standards Student Learning Objectives: Students will use a word processing application to write a short text document analyzing the scenario given, and apply the Daubert Standard or other Standard of an expert’s testimony and whether it meets the scientific requirements based on reasoning and methodology for the set of facts given in the scenario. Students will need to take the set of facts and determine if the methods and tools used by the digital forensic examiner in the scenario meet the Daubert or other Standard, and if not what changes could have been made to meet the standard. Students will need to research the Daubert Standard, and potentially other standards of evidence, as well as the forensic tools mentioned in the scenario. Each student will need to include AT LEAST 3 References one of which may be the textbook for the course. Proper citation of the sources used as references will need to be made both in the text of the document as well as at the end in a Reference list. Use a common form of citation such as APA or IEEE, the Purdue Owl website is a good resource for how to properly cite works and create a reference list: https://owl.purdue.edu/owl/purdue_owl.html Student Tasks: Write a short Word document (2 to 3 pages) answering the question presented at the end of the scenario covering a fictitious company called Sunny Smiles Everyday, Inc. Scenario: You were recently hired by Sunny Smiles Everyday, Inc. (SSE) a dental supply company that provides dentists and dental clinics with various tools and products. SSE provides services to more than 2,000 dental clinics, large and small, across the United States. SSE is based in Minneapolis, Minnesota and has roughly 5,000 employees and revenue of over $2.5 billion annually. Because you took a class in college related to digital forensics your manager has asked you to help out with an internal investigation related to a matter that was recently brought to management’s attention. John Smith, a salesperson who is based in Madison, Wisconsin has been placed on administrative leave due to allegations that he has been using the company provided list of customer data for personal purposes for profit. It has been alleged that John took the proprietary customer data that was generated through SSE’s business processes and housed on its systems to sell to third parties, including competing dental service firms, for payments totaling $250,000 over the last several years. John’s company issued laptop was seized when he was confronted in the Madison office of SSE after allegations of his wrongdoing came to light. Steve Jones, an IT employee of SSE who runs their digital forensic lab, was sent to Madison to retrieve the laptop and bring it back to the company headquarters in Minneapolis for a forensic investigation. When he confronted Mr. Smith, he had him start up the laptop and use his username and password (which he recorded) to login to the device to make sure that it was working properly and then he shut it down. He then placed the laptop in the front seat of his car and drove back to Minneapolis, because he got home late he went home and left the laptop in the car overnight, he drove to work in the morning and brought the laptop into the SSE IT lab. Once in the lab, Mr. Jones used a free version of FTK Imager version 3.2 that he found on a GitHub site of a digital forensic enthusiast he follows. SSE has not provided Mr. Jones with much of a budget for the forensic lab so he has had to rely on tools he can find that are either open-source/free or as inexpensive as possible. After making the digital copy of Mr. Smith’s company laptop he placed it into a bag in the evidence file cabinet located in the hall outside of the lab. Mr. Jones then used the copy that he made of the laptop’s hard drive to analyze it for any evidence related to the alleged act by Mr. Smith. He used an open source tool called Autopsy version 4.14.0 to analyze the drive, and found various evidence that appeared to show that Mr. Smith had indeed been selling SSE’s data to outside companies for a personal profit. He found an Excel spreadsheet that was password protected (though he tried the password Mr. Smith used to login to the laptop and it was the same) and found records of dozens of payments over the course of 4 years from multiple competitors of SSE. He also found notepad documents which had been used to draft emails he sent on his personal Gmail account back and forth with employees of those competitor companies, negotiating payments for the information he provided. Mr. Jones made digital and hard copies of all the evidence he found and erased the copy of Mr. Smith’s laptops hard drive as he didn’t need it anymore. He then presented the evidence to SSE’s management. You have been asked to review Mr. Jones’ methods and tools he used to capture the digital evidence on Mr. Smith’s alleged wrongdoing. You will need to research the tool he used and analyze the methods in which he gathered and prepared the evidence which he presented to SSE management so that they can move forward on a decision about Mr. Smith’s employment or possible termination (and maybe other legal actions against him). To organize your report make sure you answer the following questions: 1. Were the methods Mr. Jones used to acquire, handle, and analyze Mr. Smith’s laptop appropriate? If not what should he have done differently? 2. Were the digital forensic tools Mr. Jones used appropriate and do they meet evidentiary requirements for scientific examination? What standard should be applied in this case? 3. If Mr. Jones were required to present the evidence he gathered on Mr. Smith in a court of law would he be considered an “expert witness”, is there any other information about Mr. Jones that you would like to know before making that determination? Make sure to provide at LEAST 3 references and properly cite them in your report!
