R. v. Millar (1994), 31 C.R. (4th) 315 (Ontario Court, General Division) Millar was charged with first-degree murder in the killing of his father. In a fren- zied state and blind with rage, Millar struck the fatal blow. For over 25 years, Millar had been dominated and humiliated by his father. The court found that Millar had been physically, sexually, and psychologically abused in ways that can only be described as cruel, insensitive, inhumane, and unthink- able. The judge noted that in more than 20 years in the practice of criminal law, this case stood out as one of the most tragic. Shortly before the killing, Millar’s father menaced him with a knife and castigated him in a cruel and inhuman fashion for his inade- quacies. The father’s rage was due to Millar’s failure to respond to his father’s sug- gestion that it would “be nice to have a glass of milk.” The jury found Millar not guilty as charged but guilty of the lesser offence of manslaughter. After being released on bail pending sentencing, he faithfully attended treatment sessions. (life imprisonment)
