Here’s the question: If we started to connect criminal behavior to things like brain damage (think Aaron Hernandez and the concussion discussion around the NFL) then we must consider the impact of that during sentencing. This starts to reduce culpability. (Ie: I did it but I couldn’t control myself because of the brain damage I sustained in the NFL) So, should we consider and allow this into our justice system as daily practice or should this science be denied, leaving justice to focus on the act and the victim?
