His attorney argued on appeal that this was an invasion of his privacy and the DNA results were inadmissible. The prosecutors argued that a cheek swab was no more invasive than a fingerprint. The Maryland Court of Appeals reversed the conviction and sent it back to a lower court. As a result, 16,000 DNA profiles collected postarrest but preconviction could not be used pending the final appeal.
