All necessary works has been done and the mining permit has been given to DEF Son Bhd. However, till date DEF Son Bhd have not make payment for the services rendered and recently send a letter to William with a cheque amounting to RM6,000 as full and final settlement without admission to any liability. William check in the money but did not indicate his acceptance to this concession nor agreed to the arrangement and upon drawing the monies of RM6,000, William instructed his lawyers to claim the remaining RM6,000. DEF San Bhid argued that payment has been made since William had draw the cheque.
