The decision to plea bargain is often closely aligned with the same criteria used in the decision to prosecute, e.g., quality of evidence, witnesses, potential legal defenses, etc. Develop a point value scale that will facilitate prosecutorial decision making relative to the amenability of plea bargaining. The point scale should address the following parts.
Part A Variables: Consider all the probable variables that would go into a decision and assign point values to each identified factor. For example, award a point for the presence of an eyewitness (or not), etc. Identify additional variables to total ten (10), each variable being worth one (1) point on the decision scale.
Part B Instructions: When you complete the scale, provide basic instructions for its use. For example, consider a point total of 8-10 as indicative of a “no go” decision (no plea bargaining) and a score of five or less as pointing toward favoring plea bargaining.
Part C Sample Scenario: Include a brief sample scenario to demonstrate how facts in a case would be applied to the scale and how a case assessment would be rendered. In the scenario address each of the variables and then draw a conclusion based on the scale.
