Special Agents with Homeland Security Investigations have downloaded 13,866 images and videos, amounting to more than 20 GBs, of known Child Sexual Abuse Material through the qTorrent Peer2Peer software. During the download, the Agents identified the IP address the files originated from, and conducted a WhoIS Search in order to determine the ISP. Once completed, they subpoenaed the ISP, who stated during the time of the download, the IP address was assigned to subscriber Phillip Sherman of 42 Wallabby Way, Forysth, GA 31029.
Agents then went to 42 Wallabby Way, where they identified two vehicles parked in the driveway. One vehicle was registered to Phillip Sherman and the second was registered to Darla Sherman. A search for wireless networks from the street showed one wireless network, “SharkBait”, which was secured. No other houses were within a quarter mile of 42 Wallabby Way. Records checks of both individuals identified that Phillip Sherman was a 47-year-old dentist with no criminal record and Darla Sherman was a 20-year-old with one DUI arrest on the Middle Georgia University Campus.
The Special Agents have asked you to assist them with writing a Search Warrant to collect items of evidence related to the Possession and Distribution of Child Pornography.
