Your adult brother, Sonny Skyes, suffers from a mental impairment and has been jailed a number of times for minor crimes in your small community. Some of them involve inappropriate behavior toward children. Unhappy with his behavior, a group of community residents has organized, demanding that he be “put away before something really serious happens.” Out of concern, you have joined a state-wide association that advocates for the mentally impaired. One of its platforms advocates therapeutic jurisprudence for those with mental impairments. You want to investigate this approach in order to better inform those in your community.
- What is meant by this term?
- How does it differ from the traditional legal approach to criminal behavior?
- If you were to give a community presentation on treatment programs, what information would you want to impart about programs that divert persons with mental impairments from the criminal justice system to community treatment?
- What is needed for those with mental impairments re-entering the community from jail or prison?
- What things are needed in order to ensure the success of such programs, and what role would mental health courts and re-entry courts play in all of this?
