Legal and Ethical Considerations for Group and Family Therapy
Legal and Ethical consideration with individual versus group and family differs. Although the client is asked to sign non-disclosure known as HIPPA forms, individuals are still prone to discussing matter outside of therapy. before beginning the therapy with groups and family, the extent to which the invasion of confidentiality and privacy goes should be explained to the group as a whole. What is consider privacy in one culture might be seen as a comfortable topic for discussion in another. There are certain topics in a group discussion, depending on the culture that is can be avoided due to discussions with all members of the family. Understanding the breadth and depth of rituals in the lives of couples and families will provide the couple and family therapist with rich opportunities to facilitate relational change (Imber-Black, 2019).
Next, the Age factor into some in the group or family determining the level of privacy and confidentiality that can be given to an individual. A discussion in a family group therapy about a child behavioral will possibly be open for discussion with extended family members depending on the way the culture perceives age. “Younger children are not to listen to older folks’ business”, a notion that can be applied to a mindset of some members of the group as a way to excluded children out of a certain discussion.
Unlike group and family therapy, in individual therapy, the challenges to maintaining confidentiality and privacy in therapy are less due to the number of individuals having access to provided information. Often, discussion of the client problem outside of therapy is fostered can be disclosed by the client and the therapist. Also, in individual therapy autonomy is prominent as it is only one person compared to a group where the autonomy lessens as the therapist guides the group to have everyone one the same page.
Therapeutic Approaches
To maintained order, the therapy should educate parents on the need that children also have autonomy. Children can speak to a therapist in the absence of the parents if needed. Parents should also be educated on the guidelines that discussing the children’s needs or other member needs can negatively impact children’s participation therapy as they may not feel secure in opening up to the group. Given that group therapy has less autonomy, the therapist guides the group to have everyone on the same topic to facilitate an effective therapeutic discussion. Using a direct approach to bring focus to current group discussion is vital in maintaining ordinance within the group. The therapist should try to include all members in the group discussion by asking each one to express their views and feelings while assisting silence members to speak and understand their rationale for not speaking (Koukourikos & Pasmatzi,2014).
